Laws and Regulations
The Integrated Planning Act 1997 governs the development process in Queensland. You can download a copy by going to http://www.legislation.qld.gov.au/Acts_SLs/Acts_SL_I.htm then click on Integrated Planning Act 1997.
The Integrated Planning Regulation 1988 provides details on how the act is to be applied. For instance, it details the information that must be given to the public for impact assessable developments. You can download a copy by going to - http://www.legislation.qld.gov.au/Acts_SLs/Acts_SL_I.htm then click on Integrated Planning Regulation 1998.
Master Plans
The South East Queensland Regional Plan has recently been published by the Queensland Government’s Office of Urban Management. This plan will guide development in South East Queensland until 2026 and will be reviewed every five years. You can obtain a printed copy (free) by going to http://www.oum.qld.gov.au/?id=381 and filling out the form. Or you can download the plan at http://www.oum.qld.gov.au/?ID=241.
Maroochy Plan 2000 is the “town plan” for Maroochy Shire. It came into being on 30 June 2000. However, developers were given a two-year period of grace to submit applications under the less rigorous superseded planning scheme. You can view Maroochy Plan 2000 at - http://ww.maroochy.qld.gov.au/site/
Maroochy Shire Council
Do you want to know if any recent applications for developments in your area have been submitted to Maroochy Shire Council? You can download recent lists of applications received by going to http://www.maroochy.qld.gov.au/sitePage.cfm?code=daily_apps.
Local Law 19 is Maroochy Council’s rules regarding protection of vegetation. It is supported by Local Law Policy 19, which details how the law is to be implemented. You can download them both by going to http://www.lgp.qld.gov.au/Default.aspx?ID=134 , accepting the disclaimer and in the first two search fields select “Maroochy” and “Vegetation”. Click on "Search" and then download both the law and the subordinate law.
Environmental Defenders Office (EDO)
The Environmental Defenders Office (Qld) Inc. is a non-profit, non-government community legal centre. It is dedicated to providing legal advice and representation to individuals and community groups working to protect the environment.
EDO has published a series of 12 fact sheets related to planning law. Go to - http://www.edo.org.au/edoqld/index.html and click on 'Fact Sheets'. Select a couple that interest you to get an idea of the information available.
Environmental Legislation
At http://www.qccqld.org.au/resources/qld_env_legal.pdf you can download a publication titled "Synopsis of the Queensland Environmental Legal System". It is a 32 page summary of the legislation related to environmental protection. Much of it is relevant to the development approval process.
